Barcelona Tourist Licence Ending: Renovating for Residential Use

Quick answer: When a Barcelona tourist licence ends, the flat can become a long-term home or rental without a full renovation, as long as it is already a lawful, habitable dwelling. The city plans to end its 10,101 existing tourist-flat authorisations in November 2028. What decides the project is the rent you can legally charge, the condition of the flat and the paperwork that ends the tourist activity, not the new kitchen. Works can lift the permitted rent by up to 10%, but only under specific legal conditions.

For an overseas owner, the next use of the apartment is a planning question now, not in 2028. This guide covers the rent you can ask, the refurbishment that may be needed and when improvements change the rent.

If you already know the flat needs work, see our apartment renovation service in Barcelona; for everything we do, see our home renovation services in Barcelona.

Key Facts at a Glance

November 2028 is the planning horizon. Barcelona plans not to renew the 10,101 tourist-flat licences in its municipal plan, the measure often reported as the city’s “Airbnb ban”.
A HUT registration is not a cédula. A former tourist flat needs a valid residential basis and the relevant habitability documentation.
Tourist income is not a previous rent. With no residential tenancy in the preceding five years, the state reference ceiling applies in Barcelona, even to an owner with a single flat.
Works can add up to 10%, never more. Qualifying rehabilitation, energy or accessibility works allow up to 10% over the last residential rent. Ordinary redecorating does not qualify.
A ten-year tenancy is the other route. A qualifying ten-year contract unlocks the same increase without any works.
An 11-month contract is not a way out. In Catalonia, temporary lets for work or study follow the residential rent rules.

What Happens When Your Barcelona Tourist Licence Ends?

The city’s policy is to return the existing tourist homes (habitatges d’ús turístic, HUT) to residential use rather than renew their authorisations, as set out in the Ajuntament de Barcelona’s tourism-management plan. The legal basis is Catalonia’s Decreto-ley 3/2023: authorised tourist homes in the listed municipalities must obtain a planning licence within five years or stop the activity. The decree entered into force on 9 November 2023, so the transition ends in November 2028.

The Constitutional Court dismissed the challenge to the decree in STC 64/2025 of 13 March 2025. That upholds the framework; it is not a ruling on every individual flat.

The decree also allows one extension of up to five more years if the owner proves the transition does not compensate the loss of the authorisation. It must be requested from the Ajuntament between November 2027 and November 2028. It is conditional, not an automatic renewal, and not a safe income assumption. Neither future bookings nor a platform listing protect an activity once its authorisation has ended.

Choose the Next Use Before Your Barcelona Tourist Licence Ends

Next useFirst decisionRenovation priority
Your own homeHow will you live in it throughout the year?Comfort, storage, everyday kitchen use and a layout that suits you.
Long-term residential rentalWhat is the lawful initial rent, and does the budget work at that figure?Habitability, durable finishes, reliable installations and manageable maintenance.
Sale as a residential flatWhich defects or missing documents will affect a buyer’s decision?Resolve those issues before committing to expensive cosmetic work.
Genuine temporary lettingCan the temporary purpose be documented, and which tenancy rules apply?Residential suitability and a scope justified by the lawful income.

Choose a base case and one fallback. A sound two-bedroom layout can serve both a rental and a sale; a third sleeping space that cannot qualify as a bedroom serves neither.

Does a Former Tourist Flat Need a Change of Use or a New Cédula?

Not automatically: many HUT properties are already dwellings. Check the authorised residential use, the previous plans and the actual condition before deciding whether a planning change of use is needed.

Keep three matters separate: ending the tourist activity and updating its registrations; authorising any building work; and documenting the habitability of the resulting home. A contractor’s invoice resolves none of them.

Ask a competent technician to compare the existing cédula de habitabilidad, the authorised layout and a measured survey, and to explain any discrepancy in writing. A flat advertised with three bedrooms may contain rooms that were never approved.

The Generalitat issues different certificates for existing homes and for homes after rehabilitation, so a full redistribution can change the route. A valid cédula is not permission to build any layout you like: room sizes, daylight and ventilation must still meet Catalonia’s minimum habitability conditions. Our cédula de habitabilidad guide sets out those minimums.

How Much Rent Can You Charge After Tourist Letting?

The nightly rate is not the starting point. In Barcelona’s stressed-market regime, first establish the recent residential tenancy history and whether you are a gran tenedor (large holder): in Barcelona’s designation, an owner of five or more residential properties in the stressed zone. The reference ceiling comes from the state rent index, SERPAVI.

Situation at the new lettingStarting point under the current framework
Residential tenancy in the preceding five years; owner is not a large holderThe last residential rent, plus the contractual annual update. Any 10% increase is assessed separately.
Residential tenancy in the preceding five years; owner is a large holderBoth the previous-rent rule and the reference ceiling apply. A qualifying increase does not remove the index limit.
No residential tenancy in the preceding five yearsThe reference ceiling applies, including for small owners. Previous tourist income provides no baseline.

The March 2024 designation expressly applies the no-previous-contract rule to Barcelona. It was published for three years, to March 2027, and can be extended, so check it again for a tenancy that starts after 2028. Keep the SERPAVI report and evidence of the last rent. If the calculator gives no result, take advice: that is not permission to charge any rent.

Can Renovation Let You Increase the Rent by 10%?

Sometimes, and only under conditions. Article 17.6 of the Ley de Arrendamientos Urbanos allows a maximum of 10% over the last residential rent of the previous five years, on top of the annual update, when one of four conditions is proved.

Qualifying routeEvidence to plan before committing
RehabilitationStructural works (structure, façades, roofs) costing over 25% of the flat’s value excluding land, or subsidised rehabilitation, as defined in article 41.1 of the IRPF Regulation. Finished within two years.
Energy improvementBefore-and-after energy certificates proving a 30% saving in non-renewable primary energy, with the works finished within the previous two years.
Accessibility improvementProperly documented accessibility works, finished within the two years before the new contract.
Ten-year tenancyA term of at least ten years, or an extension right the tenant can use on the same terms for at least ten years.

A quote headed “full renovation” does not meet the legal definition of rehabilitation; have the works classified before you rely on an increase. For the energy route, commission the baseline certificate before touching the flat: it must have been registered no more than two years before the works. A lower electricity bill or a better letter rating does not prove the 30% saving. Our guide to energy-efficient renovation for non-resident owners covers the physical improvements.

Meeting several conditions does not raise the maximum above 10%, and where the index ceiling applies it remains a separate limit. For a former tourist flat with no residential rent in the last five years, there is no previous rent to increase at all.

An illustrative example before you approve the budget

Suppose an adviser confirms a previous-rent baseline of €1,000 a month, a qualifying improvement and no lower index limit. A full 10% increase adds €100 a month, or €1,200 a year before costs and tax. An illustrative €18,000 of qualifying work would take 15 years to recover through that extra rent alone. Judge the work on its other benefits too, not on an optimistic rent forecast.

What Should You Renovate for a Long-Term Rental?

A guest can live with a suitcase beside the bed for three nights; a resident needs somewhere to store clothes, wash laundry and work. Start with a condition survey and a room-by-room schedule.

1. Resolve defects and habitability first

Inspect damp, water ingress, drainage, electrical safety, hot water and ventilation, and establish which walls and shafts can be altered. A leaking shower or an unsafe installation comes before replacing finishes that still work.

2. Make the layout work for daily life

Review wardrobes, laundry connections, worktop space and furniture clearances, and keep compliant daylight and ventilation in bedrooms. Removing an extra tourist bed may improve the home more than adding a partition. The occupancy on the cédula should match the way the flat will be advertised.

3. Specify comfort and maintenance together

Consider draughts, overheating and noise in the rooms people use most. Window work may need approval from the comunidad de propietarios. Choose fittings that can be repaired locally: an unusual imported tap becomes an expensive problem when its cartridge fails.

Ask for separate prices for essential repairs, functional improvements and optional upgrades. Our apartment renovation team in Barcelona can define the physical scope; put the rent assessment next to it before you approve anything.

Budget for the Whole Transition

There is no standard price for converting a flat once its Barcelona tourist licence ends. A sound dwelling that needs maintenance is a different project from a flat with unapproved partitions or failing services. Use our apartment renovation cost guide for broad budgeting, then get an itemised quote.

Budget lineWhat to establish
Survey and adviceMeasured plans, technical assessment and any tenancy or tax advice.
WorksQuantities, trades, materials, waste removal and explicit exclusions.
Permits and certificatesMunicipal procedure, taxes and fees, energy certificate and cédula route.
Transition costsEmpty months, storage, insurance or management changes, and letting preparation.
ContingencyA stated reserve for what the survey cannot confirm before opening up.

Works on a flat that will be let are taxed at 21% VAT: the reduced 10% rate applies only when a private individual renovates a home for their own use, according to the Agencia Tributaria. Ask for VAT to be stated separately.

A Practical Sequence for Overseas Owners

1. Collect the file: title, HUT documents, cédula, energy certificate, old plans, previous residential contracts and community rules.

2. Check the residential outcome: a measured assessment and a written rent analysis for the intended contract date.

3. Approve the scope: mandatory corrections separate from optional improvements, plus the baseline energy certificate if relevant.

4. Confirm permits and dates: the right Barcelona renovation permit, community approvals and the lawful end of tourist bookings.

5. Carry out and document the work: invoices, progress records, updated plans and photographs of services before walls are closed.

6. Complete the handover: defects resolved, certificates obtained, tourist activity formally ended and tenancy documents checked.

Plan backwards from the date you want a resident in the flat. For remote projects, agree who approves changes and what evidence comes with each payment. Our renovation service for owners living abroad explains how the works can be managed from another country.
